I will arrive at 4:15 for the warm up exercises. We start on time at 4:30.  Each session is 4 hours long. If we have to start late, we will finish late. If I cannot show up for a class, I will call Wendee before class at (760) 434-3566 or Cell 760-889-5556. For the benefit of the group and for the best results, I will fully participate in every class, the DateSmart Socials and the practice dates.  I will not leave in the middle of the class unless I am sick. Should I leave in the middle of class, I will forfeit all future classes with no refund.

I will maintain the confidentiality of the personal issues discussed in class and on predates. Be willing to give 100% support and attention, especially when others are speaking.

 I understand that Wendee Mason is not a licensed counselor and I release her and her DateSmart Coaches and speakers from liability from any advice I follow that she gives in or outside the class. Any advice that I use will be at my own risk, and it is my responsibility to determine what is in my best interest, and will also take into consideration any consequences of following advice given in and out of class.  I also understand that Wendee may not be teaching every class, and there may be a DateSmart Coach that will teach part or all of the classes should Wendee not be available.

 I will not copy the manual, audiotapes, flash cards and support material–they are copyrighted and are for sale.

 The workshop will be taped each week. These tapes will be available to absent class members for sale and will be edited for sale to the general public. I consent to any recording of myself on video, audio, paper or digital medium by SmartWorks or its employees. I authorize the use of such recordings for educational or commercial purposes. I grant full permission for SmartWorks to use my name, and likeness, performance, voice and biography to promote the program. I waive the right to any fees or control of the programs, now or in the future. If I do not want to be on video, I agree to sit behind the cameras. If I do not want to be on the audio, I agree not to speak in class. I understand that the audio CD’s are not edited before distribution and I am responsible for my own behavior, words, actions that will be recorded and distributed for sale.

 CD’s for Absentees:  As a courtesy, if I am absent, I will be sent a CD recording of the class I missed. I will give SmartWorks a credit card number in advance of receiving any CD’s as a deposit. If I do not wish to give a credit card number, I will submit a $20 check or cash as a deposit. If I do not give a deposit, I will not receive any CD’s should I be absent. I am expected to listen to the CD’s that week and return them the following week. When I return the CD’s, I will give my instructor $5.00 for the cost of materials, labor, shipping and handling.  Should I decide to keep the CD, the cost is $20.  If the CD’s are not returned by the eighth class, I will be charged $20 on my credit card, I give permission to SmartWorks to debit $20 from my checking account or credit card for each set of CD’s that are not returned. If I do not want the CD’s sent to me, I will notify the instructor by the end of class one.  The entire DateSmart class is available on CD for $149.                                                                    
I agree to pay for my catered meals during the course. I owe $50 cash at class one for 8 meals. If I do not pay this amount, I give Wendee Mason permission to debit my credit card or checking account for the amount I owe my food, not to exceed $51. Food money is non-refundable and non-transferable as it goes to the caterer at the beginning of the session.

Cancellation and refund policy:  Once a deposit is made, there is a non-refundable $350 cancellation fee per person, which also covers materials. Materials are non-refundable. Once I start a class, if I drop out, there are no refunds. All classes are transferable and can be rescheduled without a cancellation fee.  Make-up classes are available within one year of the date of enrollment without further charge. If I don’t make up my classes or start the class within one year, I will lose the entire fee and not receive a refund. If the instructor dies, is disabled, or discontinues the classes, another instructor may teach the class, or I will be given the entire program on CD or DVD series in lieu of the live class and will not receive any refund. I will also receive two hours of one-on one phone coaching with Wendee or another DateSmart Coach in addition to the DVD or CD series.

 Missing a class does not alter my total tuition obligation since SmartWorks has reserved one place. If I am paying on a payment plan, I may not cancel my credit cards or checks as there are no refunds for missed classes. If my credit card is cancelled, I will give Smartworks my new credit card number. If my check is returned for non-sufficient funds, I will be charged $20.00, and all future payments will be by credit card or cash. Should I want to retake a class that I have previously taken, each single review class will be $25 plus food fee or $200 plus food fee for the series of eight classes.   

In the very rare case, I am requested to leave the class by the instructor after one warning, because of disruptive behavior or inappropriate conduct which damages the other students’ learning experience NO REFUND will be given for those classes I missed or will miss because of my disruptive behavior. This includes not showing up for practice dates, verbal or physical disruptions or complaints from other participants or leaving mid class. Should there be a disagreement, I agree to arbitration in lieu of court.

DateSmart Materials Policy and DateSmart Tab

I am authorizing Wendee Mason to create a tab with my credit card on my behalf for the following items pertaining to the course.

 In the event I am absent, a CD will be sent to me so I may listen to the class I have missed.  The rental fee for the CD is $5 cash or $5.50 on a credit card. If I keep the CD it is $20 per set.   

If I want these CD’s sent to me, SmartWorks must have a credit card number on file to ensure payment.  My credit card also may be used for any of the following DateSmart products below.  This card will not be used unless advance notice is given to me.   

If I do not have a credit card, SmartWorks requires a $20 cash or check deposit.  This deposit will only cover the first CD set borrowed.  If the CD is not returned, I will not receive future CD sets.
